We are asking you to pray for a second high-stakes abortion case before the United States Supreme Court.

Tomorrow, Wednesday morning, April 24, at 10 AM Eastern Standard Time, SCOTUS will hear oral arguments in State of Idaho v. United States of America. At issue is whether the Emergency Medical Treatment and Active Labor Act (EMTALA) passed by the U.S. Congress in 1986 preempts Idaho’s state abortion ban, the Defense of Life Act, therefore requiring emergency room doctors to perform abortions.

EMTALA requires all hospitals that participate in Medicare to provide medical screening and stabilizing treatment for emergency medical conditions, regardless of whether the patient is uninsured or unable to pay.

EMTALA explicitly states that hospitals are required to provide treatment to stabilize emergency medical conditions for everyone, including both a pregnant mother and — significantly — her “unborn child.” EMTALA specifically references the “unborn child” four times.

EMTALA does “not preempt any State or local law requirement, except to the extent that the requirement directly conflicts with a requirement of this section.”

In a case similar to the Idaho case, State of Texas v. Becerra, Texas challenged a July 2022 Guidance issued by the U.S. Department of Health and Human Services (HHS) declaring that EMTALA mandates the performance of some elective abortions.

Alliance Defending Freedom attorneys are assisting both the State of Idaho and Texas in these two cases.

SCOTUS will likely not release its opinion on the Idaho case until this June. The High Court’s ruling in this case is important as it could potentially establish that EMTALA preempts state abortion bans, including the ban in Texas, and require emergency room doctors to perform abortions.

Please Pray Specifically for:

  • The health and safety of the attorneys representing the State of Idaho participating in oral arguments; that they are able to make their arguments and field questions from the Justices with divine wisdom, clarity, discernment and persuasiveness to overcome the U.S. Government’s case.
  • SCOTUS to support the life of both mothers and unborn babies by ruling that EMTALA does NOT conflict with, and therefore does NOT preempt, Idaho’s Defense of Life Act.
  • The health and safety of all of the Justices and that they will receive the truth in their hearts and minds to prioritize the protection of both mothers and their unborn children:
